    No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.

    If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.

    If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

    You are correct. When I filed on 2005 I did not apply for either AP or EAD. My H1 was valid until May 2007 and I do not intend to change jobs or travel(my country is too dangerous :mad: ).
    I am already 55 :rolleyes: and am not going anywhere.
    In January 2007 I filed EAD myself and got it approved in 40 days. My lawyer was charging me $400 to file it.

    We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.

    Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.

    I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.

    I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.

    Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.

    I think this bill will not be passed if it is against WTO trade regulations.


    I totally agree with you. H1b and employment based GC's are so intertwined that they are almost inseparable. For example, you can get H1b extension based on your pending/approved PERM labor or your approved I-140 application. So, any change to H1b will in some way impact the GC process. I'm all for closing the loop holes in H1b provided certain reforms are also made in the EB green card process- like removing per country quotas and may be give EAD upon I-140 approval.

    How long are we going to hang in there? :mad: Thanks everybody for support and advice, but, there is a problem here. I am mad at USCIS, not the supportive people here. I am a concurrent filer, I don't even know if my package was lost, if it was transfered or not. Or, if it was tranfered if it was a successful transfer. Every other implication aside, it is worth a lot of money. :eek:

    May be I am too negative, but, my J-1 waiver package was lost back when it was done by paper. Literally lost (!), although I could locate the person who signed it in. My SS#, all background information, a check showing my checking account were in it. I told them, my privacy information is in it after I applied for the waiver again. I asked them if they could look for the envelope and destroy it. They "nicely" told me I have no rights at all to make such a request. I asked them if they have a system of destroying people's private information if it is no longer use, they said no.

    These should be our simple rights as a people who pay taxes in this country, although we are not residents yet. We can go to court for an everyday dispute, but at USCIS no rights.

    Anyway, thanks for involuntarily sharing.

    As far as my knowledge goes, there is no streamline email for NSC. We did send emails to NSCSfollowup and SCOPPSCAT .. and got standard script response for both.

    It is not popular to say so but I have this doubt too.
    Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.

    Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.

    All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.

    Hope AC21 don't go away like labor substitution has. :(





    i don't what is the problem you have with AC21? it works just fine and nobody has a problem with it.

    if you ask them to mess with it, and it seems to have no problem, they will either make it worse or take it away.

    i think you guys are far too risk averse and want everything guaranteed in black and white. it does not work that way and we are not so important in the scheme of things anyway.

    Knowledge of Infopath and Sharepoint is a HUGE PLUS!!! As well as any Accounting experience.

    And to make matters worse, this jerk married a Mexican woman. He is alway behind Mexico and Mexicans for some reason. Imagine that, he lives in NJ, has a several acre house, makes 7/8 figure salary and then teaches American middle class a lesson to avoid goods produced in China/Mexico/India. Avoid them because they add up to trade deficit of USA, avoid them because those countries have stolen jobs from middle class Americans. Why doesn't Lou Dobbs stop using software written by some Indian/Chinesse guy? Why doesn't he stop eating at a place where in the kitchen a Mexican guy is making his meal? why doesn't he stop using Japnesse cars? Why doesn't he quit eating Pizza....afterall it is Italian food? Why doesn't he stop driving on interstate highways...part of those were made by African Americans. I am asking Lou Dobbs to show me his grand father's VISA/I-94 when he came to the USA, on a ship, half starved, half naked from some european country and never went back! This guy blames mexicans/legal or immigrations for this country's broken health care system. Other day, he was concerned that in California, especially L.A. and surrounding area, white people's percentage has gone below 50%, Mexicans and Indians are having too many kids, whites are not having enough kids.........this is by far the most racist program CNN runs and we need to do something to put a stop on it.

    You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

    I just verified the online status and the case is approved.I got approved in july-07, then applied for my wife (I got married after mine was filed). I have registered to post this message so that it might help anyone who is tracking...

    This actually ends my GC journey as my 9 month old was born here.

    I never heard of an RFE for H1b extension. Are u sure that the RFE is not related to your I-140 or I-485?
    H1b extension should be a smooth sail.
